The Federal Land Bank of Springfield, Plaintiff, against (1) Edward R. Cassidy and (2) Nelle I. Cassidy, his wife, (3) B. Jermain Savage, as Testamentary Trustee under the Will of William R. Cassidy, (4) Frances Eliot Heiner and (5) Juliette B. Bevington, individually and as Executrices of the Estate of John Clinton Cassidy, deceased, (6) Gerald Champion, (7) Robert Cassidy, Defendants.

To the above named defendants: You are hereby SUMMONED to answer the complaint in this action and to serve a copy of your answer, or, if the complaint in not served with this summons, to serve a notice of appearance on the plaintiff's attorney within twenty days after the service of this summons, exclusive of the day of service. In case of your failure to appear or answer, judgment will be taken against you by default for the relief demanded in the complaint.

TO DEFENDANTS EDWARD R. CASSIDY and NELLE I. CASSIDY: The foregoing summons is served upon you by publication pursuant to an order of Hon. Francis Bergan. a Justice of the Supreme Court of the State of New York, dated the 17th day of December, 1937, and filed On December 20th, 1937, with a copy of the complaint in the office of the Clerk of the County of Albany at the County Court House in the City and County of Albany in said State, the original complaint having been filed in said office on the 14th day of December, 1937.

The object of this action is the foreclosure of two bonds executed by the defendant, Edward R. Cassidy to The Federal Land Bink of Springfield, one dated September 25, 1922, and the other dated April 16, 1925, and mortgage executed by the defendants Edward R. Cassidy and Nelle I. Cassidy, his wife, to The Federal Land Bank of Springfield, dated April 16, 1925, and recorded in Albany County Clerk's Office on the 16th day of April, 1925, in Book No. 468 of Mortgages at page 436.

Following is a brief description of the property affected by said action described in said mortgage and the complaint herein, viz:

ALL that tract or parcel of land situate in the Town of Knox, County of Albany and State of New York, in School District No. 4, on the old Thompson Lake Road about one-half mile from the Berne Road, and bounded and described as follows: On the North by lands now or formerly of Carrick and Whipple; on the East by lands of Palmer; on the South by lands of Cassidy and on the West by lands of Quay, known as the farm of Edward R. Cassidy, and being the premises more specifically described in a mortgage of Edward R. Cassidy and Nelle I. Cassidy, his wife, to the Federal Land Bank of Springfield, dated April 16, 1925, and recorded in Albany County Clerk's Office April 16, 1925, in Book No. 468 of Mortgages at page 456, reference thereto or the record thereof is hereby made for a full description of said premises.
